Terms and Conditions

1. Scope

For business relations between Linen UG and the consumer, only the following General Terms and Conditions shall apply. The Seller does not recognise any deviating terms and conditions of the consumer. Deviating terms and conditions shall apply only if the Seller has expressly agreed to them in writing. The texts available for concluding the contract are provided exclusively in German.


2. Contracting party

The purchase contract is concluded with Linen UG, Montgolfierallee 16, 60486 Frankfurt am Main. For enquiries about our range, delivery information, returns, etc., please use our contact form or email us directly.


3. Offer and conclusion of contract

The order placed by the customer by clicking the “Submit order” button constitutes a binding offer for all goods listed in the shopping basket at the time the order is submitted. Linen UG may accept this offer immediately after the order is placed by sending an order confirmation by email. Linen UG reserves the right not to accept orders. If an order is not accepted, the customer will be informed without delay by email.


4. Prices and payment terms

Payment of the purchase price is due immediately upon placing the order, either via PayPal, by advance payment, or on invoice. A cash discount may not be deducted. Our prices include statutory VAT and are exclusive of shipping costs.

Credit card
The financial information for credit card transactions – card number, expiry date, security code, etc. – is automatically transmitted via an encrypted protocol, without us or third parties having access to it. This information is not used again, except for refunds in the event of returns. Linen uses SSL (Secure Socket Layer) security software. This is an internet encryption method that protects your credit card data during transmission against interception and manipulation. During transmission over the internet, it is therefore not possible for unauthorised persons to read this data. The credit card is generally charged only 7 days after the order is placed.

PayPal
A PayPal account is required to pay via PayPal. Information and terms at www.paypal.com.

Advance payment
The purchase amount plus shipping costs must be paid into our account before dispatch. The account number can be found in the legal notice or in the order confirmation by email. Order processing begins only after receipt of the advance payment. We reserve the right, in individual cases and within the scope of statutory provisions, to exclude certain payment methods or to require advance payment. The prices stated at the time of ordering shall apply. Errors excepted. Please refer to the section on delivery and shipping costs for any shipping charges.

5. Retention of title

The goods remain our property until full payment has been received. Unless expressly stated otherwise in the product description, all items are delivered without the decorations shown.

6. Delivery and shipping costs

Unless otherwise agreed, delivery is made from our warehouse to the delivery address specified by the customer. Please refer to the respective product details for delivery times. If a product is unexpectedly unavailable at short notice, the customer will be informed by email without delay. If ordered items are out of stock, we offer free subsequent delivery.
  • For deliveries within Germany from EUR 189.00, we do not charge shipping costs.
  • For cash on delivery, a COD fee of EUR 5.00 applies (plus Deutsche Post transmission fee of EUR 2.00).
  • Shopping vouchers are delivered free of shipping charges.

8. Cancellation policy

Right of cancellation

You may revoke your contractual declaration within 14 days without stating reasons in text form (e.g. letter, fax, email) or – if the item is provided to you before the deadline – by returning the item. The period begins after receipt of this instruction in text form, but not before the goods have been received by the recipient and not before we have fulfilled our information obligations pursuant to Art. 246 § 2 in conjunction with § 1 (1) and (2) EGBGB, and not before we have fulfilled our obligations pursuant to § 312e (1) sentence 1 BGB in conjunction with Art. 246 § 3 EGBGB. Timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

Exceptions
There are statutory exceptions to the right of cancellation (§ 312d (4) BGB). We assert the following exceptions: made-to-measure items, special orders, custom-made items, cut-to-size goods, fabric sold by the metre. Please note the separate return rules for goods from the manufacturers Leitner Leinen, Christian Fischbacher, Schlossberg, Peter Reed, Vieböck, Alfred Collection, Genix, Graser and Pfeiler, parts of the collection from Libeco, Hoffmann and Schlitzer Leinen. The product description states that the products from these manufacturers are custom-made. Goods from these manufacturers are made to customer order and have a delivery time of 3 to 30 days. The goods are made-to-measure items produced individually for the respective customer to order and are cut individually. Due to the made-to-measure nature and individual cutting, these fabrics and other fabrics with a cut width of more than 1.5 metres or with a standing hem are excluded from return in the event of “not liking”. Promotional goods at special prices are excluded from return.

Consequences of cancellation
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return the received service to us in whole or in part, or only in a deteriorated condition, you may have to compensate us for the value. Otherwise, you can avoid the obligation to pay compensation for deterioration caused by use of the item as intended by not using the item as if it were your own property and by refraining from anything that could reduce its value. Items that can be shipped as parcels must be returned at our risk. You must bear the costs of return shipment if the delivered goods correspond to the ordered goods and if the price of the returned item does not exceed EUR 800, or if, in the case of a higher price of the item, you have not yet provided the consideration or an agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you. Items that cannot be shipped as parcels will be collected from you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your cancellation declaration or the item, and for us with its receipt.

9. Time of conclusion of contract

The presentation of products in the online shop constitutes a non-binding offer in the form of an online catalogue. The purchase contract is concluded with our separate order confirmation or the delivery of the goods. Items are reserved for 7 days after purchase. If no payment is received within 7 days, we will cancel the order.

11. Final provisions

In the event of differences of opinion and legal disputes, the law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of this contract be or become invalid, or should the contract contain a gap, the remaining provisions of the contract shall remain unaffected. The parties undertake to replace the invalid clause with a clause that is valid and comes as close as possible to the invalid clause, or to close the gap.
Returns guarantee
Unlike many manufacturers’ sellers, we offer a 100-day returns guarantee for most items. Under certain circumstances, we reserve the right to claim compensation for loss in value in the event of a return. This section provides detailed information about our return conditions.
Your statutory right of cancellation is not restricted in any way by this. Details of the statutory right of cancellation can be found in section 8 of our Terms and Conditions.

Home textiles

Returns must be made in the original condition. With home textiles such as pillows and duvets, it is of course necessary to try them out to determine warmth, height, etc. However, please ensure that you only try them in the way you would in a retail store, i.e. for example with duvets, only place them over your legs for a short time.

Please note that textiles that come into direct contact with the skin, such as bed linen, fitted sheets and towels, cannot be accepted back if used, for hygiene reasons.

Made-to-order and personalised goods at The Linen Lounge

Please note the following special conditions that apply to handmade items that have been made to your specifications or otherwise customised for you by the seller based on selection options such as made-to-measure items, inscriptions or designs (e.g. engravings, stamps, monograms, embroidery, embossing, or carving):

  • For such personalised products, the seller is not generally obliged to accept a return or offer an exchange.
  • However, if personalised products are delivered damaged, defective, or materially different from the description, e.g. with an error in size or personalisation such as a spelling mistake, you may return the item in accordance with The Linen Lounge return conditions, and your statutory warranty rights will apply.

Cut-to-size goods / goods sold by the metre

These items are cut individually to your specifications and are therefore excluded from the right of cancellation and our voluntary returns guarantee.
